The Powers That Be in Israeli Real Estate
- A Historical Perspective

It is a well known fact that the majority of the land in Israel is owned by the government. Whole cities, such as Beit Shemesh and Modiin and large parts of other cities as well, are all owned by the government. These lands are administered by a government agency called the Israeli Land Authority. The purchasers of apartments on these lands are granted a 49 year long term lease. The reasons for this are historical and it is important to understand these reasons as it gives a new perspective to purchasing property in Israel.

Until the late 19th century most of the land in Israel was unpopulated. The author, Mark Twain describes this clearly when he writes of his travels in the Holy Land at this time. During the second half of the nineteenth century, Jews began to make aliya to the Holy Land, driven both by changes taking place in their countries of origin and by ideological beliefs. It was at this time that the modern Zionist movement began to emerge.

In 1901, at the fifth Zionist Congress in Basel, the Jewish National Fund (Keren Kayemet L’Yisrael) was established. The goal of this organization was to purchase lands in Eretz Yisrael and develop them for Jewish settlement. The funding for this organization was to come from...

Legal Vocabulary

'Mifrat Techni' (Technical Specifications)   – By law, this document must be attached to and sales agreement made for the purchase of a new apartment from a construction company. It contains the exact specifications of the apartment, including the materials that the apartment is built from.

Tip of the Month

Recently there has been a change in the law regarding the Mifrat Techni. The law has always specified that a Mifrat Techni should be attached to every sales agreement made by a construction company. The problem was that many of the items in the document were not described in much detail. As a result, a purchaser did not always know, for example, what the company's obligations were with regards to things like the type of floor or ceramics they were supposed to get, what cabinets, how many electrical sockets to a room etc.. The change in the law now obligates the construction company to specify what type of materials they will be using. The purchaser therefore can know what to expect when he signs the contract. If you don't speak Hebrew well enough to understand the technical language of the specifications or would like to know if the basic "specs" are of a reasonable standard, we advise you to consult with an interior designer, architect or engineer. These professionals can also advise you as to whether you should upgrade any of the items that are specified in the Mifrat Techni.
